Section [A] 109.4 of the International Building Code is hereby amended to read as follows:

[A] 109.4 Work commencing before permit issuance. When it is determined through an investigation that any person has commenced any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits, the person shall be subject to an investigation fee established that shall be in addition to the required permit fees. The investigation fee shall be established by a resolution of the Governing Body and shall be equal to the amount of the permit fee. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of either this code or the technical codes nor from any penalty prescribed by law.
