Subsection 305.2.3 of the International Building Code is hereby amended to read as follows:

305.2.3 Care being provided in a dwelling unit in compliance with State laws and licensing programs. A facility such as the above within a dwelling unit that is providing custodial care in compliance with State laws and licensing programs shall be classified as a Group R-3 occupancy or shall comply with the International Residential Code for One and Two-Family Dwellings as adopted by the City in accordance with Chapter 15.04 of the Olathe Municipal Code.
