9.17.080 Nuisance Drug Paraphernalia.
This section is included in your selections.
A. Except as provided in subsection (B) of this Section, it shall be unlawful for any person, firm or corporation to sell, offer to sell, dispense, give away or display any instrument or drug paraphernalia, simulated controlled substance, or simulated drug in or upon any premises which:
1. Are premises open to minors;
2. Are places of display; or
3. Are in close proximity to a school.
B. Display of the items prohibited by subsection (A) of this Section for educational or scientific purposes shall not be unlawful.
C. A violation of this Section is declared to be a public nuisance and shall be subject to abatement as provided by law. (Ord. 17-48 § 9, 2017.)
