Purpose:
To set for the general public policy objectives of the city as it relates to establishing of non-smoking in public meetings and city-owned public facilities.
Statement of Policy:
The statement of policy is hereby incorporated with Resolution No. 93-1012.
RESOLUTION NO. 93-1012
A RESOLUTION ESTABLISHING A CITY POLICY PROHIBITING THE SMOKING OF TOBACCO PRODUCTS IN ALL PUBLIC MEETINGS AND ALL CITY-OWNED PUBLIC FACILITIES.
WHEREAS, House Bill 2412 regulates the use of smoking of tobacco products in all public meetings and public buildings and prohibits smoking in all areas not otherwise designated as smoking areas; and
WHEREAS, the Olathe City Council does recognize that the use and smoking of tobacco products is often offensive to many individuals and does pose a substantial health and safety hazard; and
WHEREAS, it is a fact that both voluntary and involuntary smoking is a cause of cancer;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the city of Olathe, Johnson County, Kansas, that the following be declared to be the policy of the city of Olathe:
SECTION ONE: The use of smoking materials shall be prohibited in all city-owned facilities, or in any city-owned, rented or lease vehicle unless the operator of the vehicle has no non-smoking passengers. Smoking is also prohibited in any public meetings conducted in city-owned facilities. Smoking shall not be permitted during any meetings of the City Council and its committees or any public hearings established by the city. Rooms utilized for such meetings shall be clearly posted as non-smoking areas.
SECTION TWO: The city manager's designee shall post or cause to be posted in a conspicuous place, signs clearly stating that smoking is prohibited and that city facilities are a smoke-free environment.
SECTION THREE: The health concerns of non-smokers shall be given priority consideration in resolving any conflict arising from implementation of this policy.
SECTION FOUR: This policy shall be implemented and administered by and through the city manager in accordance with the above policy.
SECTION FIVE: That this Resolution shall take effect immediately.
BE IT FURTHER RESOLVED by the Governing Body of the city of Olathe, Johnson County, Kansas, that all city personnel and officials, whether appointed or elected, and all persons using city-owned facilities are requested to recognize and abide by the spirit and intent of the policy.
