Purpose:

To establish policy for guidelines for street tree planting and the residential neighborhood design manual.

Statement of Policy:

The statement of policy is hereby incorporated with Resolution No. 02-1057.

RESOLUTION NO. 02-1057

A RESOLUTION ADOPTING AS POLICY REVISIONS TO THE GUIDELINES FOR STREET TREE PLANTINGS AND THE RESIDENTIAL NEIGHBORHOOD DESIGN MANUAL.

WHEREAS, the Guidelines for Street Tree Plantings and the Residential Neighborhood Design Manual were approved by the Planning Commission on June 8, 1998 (Resolution No. 02-98).

WHEREAS, the Guidelines for Street Tree Plantings and the Residential Neighborhood Design Manual were adopted by the Governing Body on July 21, 1998 (Resolution No. 98-1126).

WHEREAS, the Planning Commission reviewed and recommended approval of amendments to various sections of the Unified Development Ordinance (UDOA-01-01) throughout the fall 2001 and spring 2002.

WHEREAS, the amendments to the Unified Development Ordinance (UDOA-01-01) include revisions to the standards for street tree plantings, perimeter landscaping, and the location of such plantings in and around utility easements.

WHEREAS, the revisions to the Guidelines for Street Tree Plantings and the Residential Neighborhood Design Manual would ensure consistency with the amendments to the Unified Development Ordinance.

WHEREAS, the Planning Commission held a public hearing for the Group 2 amendments, including discussion of revisions to Section 2.3, Objective 2.3(G), Transitions between Large-Lot and Urban Subdivisions of the Residential Neighborhood Design Manual on August 27, 2001 and recommended approval of the revisions to the Design Manual on September 24, 2001.

WHEREAS, the Planning Commission held a public hearing for the Group 2 amendments to the Unified Development Ordinance (UDOA-01-01), including discussion of revisions to the Guidelines for Street Tree Plantings; Section 3.3, Street Tree Design Guidelines; Section 3.4, Perimeter Landscape Design; and Section 4.2, Easement Locations and Utility Design of the Residential Neighborhood Design Manual on August 27, 2001 and recommended approval of the revisions to the Design Manual on September 24, 2001.

WHEREAS, the Planning Commission held a public hearing for Group 3 amendments to the Unified Development Ordinance (UDOA-01-01), including discussion of revisions to Section 4.1, Right-of-way Utility Design of the Residential Design Manual on December 10, 2001 and recommended approval of the amendments and revisions on January 28, 2002.

WHEREAS, the City Council has reviewed the Planning Commission recommendations.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OLATHE, KANSAS:

SECTION ONE: The guidelines listed below are hereby amended and adopted as policy for the Olathe Planning Commission and the Governing Body when reviewing plans, plats, etc., for approval as provided by the Unified Development Ordinance (UDO). They shall be considered as policy (except those parts included from the UDO) and may be modified when deemed appropriate in order to accomplish higher quality development design.

SECTION THREE: These policies may be updated as other corridor studies, design guidelines, task force reports, Comprehensive Plan updates, etc., are completed.

SECTION FOUR: All the previously adopted guidelines and Design Manuals adopted by Resolution 98-1126 are hereby repealed.

SECTION FIVE: This resolution shall take effect and be in force from and after July 1, 2002.
