Chapter 13.36 of the Olathe Municipal Code was enacted pursuant to the authority of (1) K.S.A. § 12-856 and 860 relating to and authorizing, inter alia, the establishment of rates and charges for water, including the cost of extension and enlargement of the water system, and (2) Section 5 of Article 12 of the Kansas Constitution (the “Home Rule Amendment”) empowering cities to determine their local affairs and government through the enactment of home rule ordinances.
