(A) Newly Installed Fire Alarms.

(1) The provisions of this Section apply to any newly installed fire alarm system thirty (30) days after final inspection.

(B) False Fire Alarms.

(1) The fire alarm business will be assessed a fee if an Enforcement Official determines that a false fire alarm was directly caused by an on-site employee or representative of the fire alarm business. In this event, no false fire alarm will be counted against the owner.

(2) Any fire alarm system which has recorded more than one (1) false fire alarm within a twelve (12) month period will be subject to a fee. Such fee is adopted by resolution of the Governing Body.

(3) False fire alarms activated by any components connected to the fire alarm system will be included in computing the total number of false fire alarms for purposes of this subsection.

(4) The activation of a fire alarm system will not be considered a false fire alarm if the alarm is activated due to malicious causes beyond the control of the owner.

(C) Failure to pay false fire alarm fees is a violation of this Chapter. Nothing contained in this Section precludes:

(1) Prosecution in Municipal Court for violations of this Chapter and assessment of any other penalties as provided by law; and

(2) The Enforcement Official from using a collection agency to assist with the collection of outstanding fees or fines owed by the owner or fire alarm business. (Ord. 18-01 § 8, 2018; Ord. 08-80 § 1, 2008.)
