(A) Pursuant to K.S.A. 41-719, as amended, the City exempts certain City property from the provisions of K.S.A. 41-719(d). The City hereby expressly exempts the following properties, and allows sale, possession, or consumption of alcoholic liquor thereon, subject to certain conditions:

(1) For private events upon the following City properties with an approved alcoholic liquor permit as provided in subsection (B) of this section:

(a) Lake Olathe Park, including Eagles Landing;

(b) Mahaffie Stagecoach Stop and Farm Historic Site, including Mahaffie Heritage Center;

(c) Stagecoach Park, including the Olathe Community Center;

(d) Olathe Downtown Library building and any contiguous City property;

(e) Civic Center Park;

(f) Indian Creek Library and any contiguous City property;

(g) City-owned parking lots in the Downtown Area; and

(h) City sidewalks or public right-of-way pursuant to Section 7.06.060.

(2) For City sponsored or hosted events upon any City property with the prior approval of the City Manager or designee as provided in subsection (B) of this section.

(B) The City Manager or designee may issue a permit to sell, possess, or consume alcoholic liquor or cereal malt beverages on City property in designated places and for limited times, as described in the permit.

(C) Permits issued pursuant to this section shall state the boundaries of the permitted area and the period that the permit is valid. The approval, denial, or revocation of such permits is at the sole discretion of the City. The permit may include any conditions or restrictions the City deems necessary for the public health, safety, and welfare, and to protect and preserve City property.

(D) As a condition of the permit, the applicant will agree to follow all applicable laws regarding consuming of alcohol, including, but not limited to, Kansas Statutes Annotated, Chapter 41, and Titles 7 and 9 of this municipal code, and any rules and regulations promulgated thereunder. The applicant will also agree to follow all lawful orders of the division of alcoholic beverage control of the Kansas Department of Revenue and the Olathe Police Department.

(E) The City Manager or designee may issue rules and regulations to implement the provisions of this section.
