9.05.020 Lewd and Lascivious Behavior.
A. It shall be unlawful for any person in a public place, or in any other place under circumstances where such act could be observed by any member of the public, to intentionally:
1. Perform an otherwise lawful act of sexual intercourse or sodomy; or
2. Fondle or caress his or her genitals or the genitals of another person of the same or opposite sex; or
3. Expose a sex organ in the presence of a person who has not consented thereto with intent to arouse or gratify the sexual desires of the offender or another.
B. Lewd and lascivious behavior is a Class A Public Offense if committed in the presence of a person sixteen (16) or more years of age. (Ord. 14-63 § 3, 2014; Ord. 07-135 § 7, 2007; Ord. 03-73 § 1, 1993; Ord. 93-09 § 6, 1993; Ord. 83-75 § 2, 1983.)
